European Union - Family & Partner - Residency (Parent or Sibling of EEA Child)
Residency in the European Union (EU) based on a child or a sibling with EU nationality is possible because of recent European Court judgements. These override local Immigration Law in the UK, given the jurisdiction of the EU.
This particular case arises under the following conditions:
1. A child has EU Nationality
2. The child is under 18 years of age
3. The child is intending to settle in the EU country
4. The child must be under the primary care of the applicant (who must demonstrate that they provide for the child - probably financially, but also emotionally)
