United Kingdom - Passport & Nationality - British Citizenship by Descent (UKM Non Std pre 1983)

The requirements for you to become British by Descent under these conditions are as follows:

> The candidate must have been born between 01.01.1949 and 01.01.1983; AND

> The candidate can be born anywhere in the world (in other words, the birth did not have to occur in the United Kingdom); AND

>The mother of the candidate was:

a) Registered as a Citizen of the UK and Colonies in a Commonwealth country that was at the time independent of British Rule and this registration took place BEFORE the candidate's birth; OR

b) born in a UK Colony before it became independent, has either parent born in the UK, was not subject to the loss of her British Nationality with the independence arrangements and did not renounce her British Nationality before the subject’s birth; OR

c) born in place which at the time of the mother’s birth was a UK Protectorate, Protected State, British Mandated Territory, British Trust Territory or a place in a foreign country where the UK exercised extraterritorial jurisdiction over British Subjects AND the mother’s father was born in the UK; OR

d) born in a UK Colony, was not subject to the loss of her British Nationality with the Independence arrangements, and did not renounce her British Nationality; OR

e) born in a UK Colony, was not subject to the loss of her British Nationality with the Independence arrangements, did not renounce her British Nationality and the candidate was resident in the UK for five years at some stage before 01.01.1983; OR

f) born in a UK Colony, was not subject to the loss of her British Nationality with the Independence arrangements, did not renounce her British Nationality and the candidate is female and was married to a British Man at some stage before 01.01.1983.

IMPORTANT NOTES:

If you have spent (or can spend in the future) at least 2.5 years in the UK, then any of your children can become British AFTER you become British under this provision, as long as your children apply before their 18th birthday.

Women can lose British Nationality through marriage and through the action of their father whilst under the age of 21 and so there will be some who cannot qualify regardless of the above.

Birth in the UK does not always result in the candidate's mother acquiring British Nationality.
