United Kingdom - flag United Kingdom - Passport & Nationality - British Overseas Citizen (BOC) - Pre 1949 12(3)

This rare set of circumstances qualifies a person for the British Overseas Citizen (BOC) status. It arises where:

 - the applicant was born before 1949;

 - in a place that was a British ProtectorateBritish Protected State, Mandated or Trust Territory; AND

 - to a father who was born in a place that was within the Crowns Dominions.

It is essential that the applicant and their father did not suffer from the Automatic Loss provisions that were enacted upon independence of the territory, so each situation must be assessed separately. It is also possible for this BOC status to be upgraded to full British citizenship. While there are several others, the most common situations cover:

 1) a grandparent was born in the United Kingdom;

 2) the applicant is a woman with a Commonwealth citizenship who was married to a British husband before 1983; OR

 3) the applicant holds no other nationality.

WhatPassport.com is a specialist UK Nationality and British Citizenship site offering an online search and assessment. Claims to hold a British Passport can be complex and the site offers a quick, simple search to give you the answers. While many people qualify for the UK Ancestry Visa based on holding a Commonwealth passport with a UK born grandmother or grandfather, we have found that if you have a grandparent born in the UK, or if your mother is British or your father is British, then there are several scenarios where you can claim British Nationality and the right to hold a British Passport. This stems from Britain’s collection of British Colonies, British Protectorates and British Protected States in the middle of last century and the Nationality rules concerning what are now the countries of the Commonwealth.
