United Kingdom - Passport & Nationality - NEW - British Citizenship by Discretion (Pre 49 Ireland Mother)
The requirements for this solution are:
- The person needs to be born before 1949 in a foreign country;
- The father AND his parents must not be born in the UK or any of the modern-day Commonwealth countries or previous Protectorate/Protected state or Trust/Mandated Territory;
- The mother must be born in Ireland before 9/12/1922; AND
- The maternal grandparents must not be born in the UK or any of the modern-day Commonwealth countries or previous Protectorate/Protected state or Trust/Mandated Territory.
Explanation
This solution relies on proving that the applicant was born to a British by subject mother who was born in Ireland but does not became an Irish citizen as she lost her domicile there due to relocation or/and marriage to a non-Irish person. This would result in the applicant arguing that had the law been gender equal they would have become a British subject by descent and on 1.1.1949 became a Citizen of the UK and Colonies under 12(4) of the BNA 1948 with the ROA coming through that same Irish born mother.
