Research

Many claims to British Nationality are straightforward, and are made up of one of the following:

  • Born in the UK before 01.01.1983
  • A parent born in the UK before 01.01.1983
  • A parent Naturalised in the UK before your birth, and
  • Naturalisation through residency in the UK.

In such cases, no further research has to be undertaken, and applications can be made to establish British Nationality and grant a Passport.

However, most clients remain unclear on what claims to British Nationality they may have, even after trying to do their own research. The reasons for this are straightforward - the legislation is complex and the information is not easily found. So Philip Gamble & Partners provide a research service to provide clients a solution. This comes in three forms:

Status Trace

All other claims to British Nationality have to be determined by reference to old nationality law and the Independence Day arrangements (and Constitution) of the relevant countries of your family (parents and grandparents). This requires researching legal documents dating back as far as 1906. A further difficulty is that such applications do not have a standard application form, and so a written explanation of how you qualify (and why) has to be made to the Home Office - and you will be required to quote the necessary nationality law substantiating this.

Philip Gamble & Partners are specialists in British Nationality claims and offer a STATUS TRACE service to those who are struggling to find out whether they have a claim to British Nationality. The Status Trace involves an examination of your nationality documents (birth and marriage certificates, as well as old passports and other documents that can have a bearing on your nationality status). By applying the nationality law changes that took place in 1949 and 1983 (amongst others), the status of your parents, yourself, partner, siblings, children and even grandchildren can be determined. Status Trace – This costs £350, and the work is undertaken by Philip Gamble’s nationality team. They will draw the same conclusions, as Philip approves all Status Traces that are issued, but many clients prefer Philip doing the research on their behalf.

Nationality by Design

Where a young couple are living outside of the UK, and one (or both) of them are British by Descent, it is normally not possible to pass British Nationality to their children (there are exceptions, though). If this couple are planning to have children, and want to pass British Nationality to their unborn children, then a degree of planning can be done in order to achieve this. These are:

  • The parents can move to the UK and have their children in the UK. In such cases, the children become British other than by Descent, and can themselves pass British Nationality to their children.
  • The British parent can spend at least 2.5 years in the UK before the birth of the child
  • The British parent can spend at least 2.5 years in the UK after the birth but before the child turns 18

The pregnant mother can travel to a nearby country (of which they are not a citizen) and give birth there. In such a case, the child is born without nationality and then immediately becomes British by Descent. The mother and child return home, and the child can then apply for local citizenship. This route to British Nationality is called Nationality by Design.

It is advisable to get expert advice before such a decision is made, and Philip Gamble & Partners offers this advice for £350. This would take the form of a written report, detailing which local countries would not grant nationality by birth and how the British Nationality would be achieved.
