It is sometimes assumed that birth in the UK will result in automatic acquisition of British Citizenship. However, those born in the UK after 01.01.1983 only acquire British nationality through birth where one of the parents held a "Settled" status - a permanent resident or a British or Irish citizen - at the time of their birth.

If a grandmother was born in the UK, this will have resulted in the parent having the Right of Abode when they were born. The Right of Abode is considered as a "Settled" status in the UK, so it mean that the applicant was born British.

So the requirements of this solution are:

  • Candidate born in the UK after 01.01.1983;
  • Candidate's parents born outside of the UK and were NOT British or Irish citizens at the time that the candidate was born;
  • A parent was born before 01.01.1983 and had a) a mother born in the UK, and b) a father born outside of the UK. 

An interesting consequence of this set of circumstances is that an application for a British passport will almost certainly be rejected by the Passport Office, because they will not consider the applicant as British. So a special application must be made to the Home Office first to establish rights to British nationality before an application for a passport can be made.
