United Kingdom - Passport & Nationality - NEW - British Citizenship (British Overseas Territory by Discretion - Mother) Pre 83
This route to British nationality arises from a mother´s birth in a British Overseas Territory. Recent attempts to remedy gender discrimination against women in the older law has resulted in a potential claim down the maternal line. Broadly, it requires the following circumstances:
- Candidate born before 1 January 1983;
- Candidate´s mother born in a British Overseas Territory.
In 2002, the mother would have automatically been reclassified as a full British citizen. And under changes being introduced to remedy gender discrimination in the old law, the candidate should be to argue that this this gender discrimination prevented them from being born to a British mother.
PLEASE NOTE: If such an applicant has any children under the age of 18, then these children could be registered as British citizens.
