Any child under the age of 18 can be granted Indefinite Leave to Remain (or ILR) where:

  • the child is resident in the UK;
  • the child is under 18 years of age; AND
  • both parents hold a "Settled Status" in the UK.

The "Settled Status" includes anyone who a) is a British citizen, b) is an Irish citizen who is ordinarily resident in the UK, or c) has permanent residency status.

Where the child is being brought up by a single parent (and the other parent plays no role in the financial and/or emotional wellbeing of the child), and this parent has the "Settled Status", then the child can be granted ILR.
