On the entry and stay of a third country national family member of the citizen of a State party to the Agreement on the European Economic Area

Who is considered a family member?

Third country national spouse of the citizen of a State party to the Agreement on the European Economic Area, own descendant and descendant of the spouse below the age of 21, dependant child above the age of 21 and the dependent ascendants are considered family members. In case of an EEA citizen residing in Hungary for study purpose, the spouse and minor descendants are considered family members.

What are the conditions of a short-term entry?

Third country national family member of an EEA citizen may travel with his or her national passport, valid visa or, in case of visa exemption, without visa and may reside in Hungary for the duration defined in his or her visa or in the visa exemption agreement (usually for 90 days).

What do you have to do if you wish to stay in Hungary for more than 90 days?

You can apply in person for the issuance of a residence permit at the Regional Directorate (Customer Service Office) of the Office of Immigration and Nationality competent by the address of your accommodation not later than 15 days before the expiry of your lawful residence by filling out the standard form.
You may ask for exemption from the obligation of personal lodging in cases deserving extraordinary consideration (in case of elderly and sick or physically disabled persons, etc.).
It is not a necessity by lodging the application for a residence permit to have the residence visa obtained beforehand; the application can be lodged in possession of a short-term entry visa (type C) or during the visa-free residence allowed by an international agreement.
You have to know that if you miss the deadline of lodging your application for the issuance of a residence permit or for the extension of its validity and you cannot exculpate your delay, the authority in charge may dismiss your application.
