A claim for British Citizenship by birth applies where the applicant:

 1) was born in the UK after 1982; AND

 2) has a parent who was an Irish citizen at the time of their birth.

A birth in the UK before 1 January 1983 gave an automatic right to British nationality. However, the situation is different for anyone born in the UK after 31 December 1982. For an automatic right to arise, a key requirement is for one of the parents to hold a "Settled" status in the UK. This settled status is normally held by a British citizen or a person with the Right of Abode or permanent residency. However, an anomaly in the Anglo Irish agreement in 1973 means that an Irish citizen is treated as having "Settled" status in the UK.

An alternative solution if the above does not apply is if the applicant lived in the UK for the first 10 years of their life, or has lived for a majority of their life in the UK.
