United Kingdom - Passport & Nationality - British Citizenship by Double Descent (Post 82 Birth Colony)

This is an exceptional situation caused by an anomaly in the drafting of the older colonial British Nationality Law. Broadly, it requires:

a) An applicant born after 01.01.1983;

b) An applicant's parent born in a former British Colony which retained its Colony status after 01.01.1949;

c) The parents were married at the time of the applicant's birth (any claim becomes more complex if this was not the case); AND

d) The applicant to have the Right of Abode via a UK-born grandparent.

The claim relies on the relevant parent not being subject to the Automatic Loss provisions that were enacted upon Independence of the Colony. The list of British Colonies excludes those territories given wide powers of self-governance and control over their foreign affairs.
